Terms of Service for Little Bonsai

Please read these Terms of Service ("Terms") carefully before using the Little Bonsai website (the "Service") operated by Scarlet Shark LLC ("us," "we," or "our").

By creating and submitting or making available any UGC through the Service, you grant Little Bonsai a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sub-licensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such UGC in any media, format, and platform, including for commercial purposes.

This license survives the termination of these Terms.

C. Little Bonsai’s Property

The Service itself, and its original content (excluding UGC), features, and functionality are and will remain the exclusive property of Scarlet Shark LLC and its licensors. The content is protected by copyright, trademark, and other laws.

You may view, download, and print pages from the website for your own personal, non-commercial use.

You must not:

• Republish Little Bonsai's original material.
• Sell, rent, or sub-license Little Bonsai's original material.
• Reproduce, duplicate, or copy Little Bonsai's original material for commercial purposes (other than through the license granted in Section 2.A and 2.B).

3. Limited Warranty and Disclaimer

The content and materials on the Little Bonsai website are provided "as is." Little Bonsai makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, Little Bonsai does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitation of Liability

In no event shall Little Bonsai or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Little Bonsai, even if Little Bonsai or an authorized representative has been notified orally or in writing of the possibility of such damage. These Terms shall be governed and construed in accordance with the laws of District of Columbia, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 14 days notice prior to any new terms taking effect. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
